I. General Provisions

All contractual relationships are concluded in accordance with the legal system of the Czech Republic. Legal relationships not expressly governed by these terms and conditions are governed by Act No. 89/2012 Coll., the Civil Code (hereinafter "CC").
If the Buyer is a consumer (a person other than an entrepreneur who places an order or concludes a contract with the seller within the scope of their business activity), the rights and obligations of the Seller and the Buyer are also governed by the provisions of § 2158 et seq. of the CC ("Special Provisions on the Sale of Goods in Shops") and, in the case of consumer buyers, also by Act No. 634/1992 Coll., on Consumer Protection, as amended.
II. Definitions
Consumer contract – a purchase agreement, work contract, service agreement, or other contracts under the CC, where the contracting parties are a consumer on one side and a supplier or seller on the other.
Seller – the operator of the online store – a person who acts within the scope of their business or other entrepreneurial activity when concluding and performing the contract.
Buyer – consumer – a person who does not act within the scope of their business activity when concluding and performing the contract. This is a natural or legal person who purchases products or uses services for purposes other than doing business with these products or services.
Buyer who is not a consumer – an entrepreneur who purchases products or uses services within the scope of their business activity or independent profession.
III. Personal Data Processing and Commercial Communications
- Protection of the buyer's personal data, who is a natural person, is provided by Act No. 101/2000 Coll., on Personal Data Protection, as amended.
- The buyer agrees to the processing of their personal data: first and last name, residential address, identification number, tax identification number, email address, telephone number.
- The buyer agrees to the processing of personal data by the seller for the purposes of exercising rights and obligations under the purchase agreement and for maintaining the user account.
- The buyer acknowledges that they are obliged to provide their personal data correctly and truthfully and to inform the seller without undue delay of any changes to their personal data.
- Personal data will be processed for a period of 10 years. Personal data will be processed electronically in an automated manner or in paper form in a non-automated manner.
IV. Conclusion of Purchase Agreement
- All product presentations placed in the online store are informational in nature and the seller is not obliged to conclude a purchase agreement regarding these goods.
- The web interface of the store contains information about goods, including prices of individual goods and costs of returning goods.
- To order goods, the buyer fills in the order form in the web interface. The order form contains information about the ordered goods, payment method, delivery location details and delivery costs.
- Before submitting the order to the seller, the buyer is allowed to review and modify the data entered in the order.
V. Goods Price and Payment Terms
- The price of goods and all additional costs are listed in the web interface for each specific order including VAT and all related fees.
- The buyer may pay for goods and all additional delivery costs under the purchase agreement in the following ways:
- by wire transfer to the seller's account
- by online payment system
- in cash upon receipt of goods
- cash on delivery
- Together with the price of goods, the buyer is obliged to pay the seller the costs associated with packaging and delivery of goods in the agreed amount.
VI. Withdrawal from Agreement
- A buyer who concluded a contract outside of their business as a consumer has the right to withdraw from the purchase agreement without giving a reason within fourteen days.
- The withdrawal period runs from the receipt of goods by the buyer.
- To withdraw from the purchase agreement, the buyer may use the sample withdrawal form provided by the seller.
- In case of withdrawal from the purchase agreement, the purchase agreement is cancelled from the beginning. Goods must be returned to the seller within fourteen days of withdrawal.
VII. Goods Delivery
- Delivery methods, costs and estimated delivery times are listed in the web interface of the store.
- The choice of delivery method is made during the ordering process.
- Delivery costs are communicated to the buyer in the web interface and in the order confirmation.
- The seller is entitled to request the buyer to pay costs according to the size, weight, quantity or value of the goods.
VIII. Rights from Defective Performance
- Rights and obligations of the contracting parties regarding rights from defective performance are governed by the relevant generally binding legal regulations.
- The seller is liable to the buyer that the goods are free from defects upon receipt. In particular, the seller is liable to the buyer that at the time the buyer received the goods:
- the goods have the properties agreed upon by the parties, and in the absence of agreement, properties described by the seller or manufacturer or expected by the buyer with regard to the nature of the goods and advertising
- the goods are suitable for the purpose stated by the seller or for which goods of this type are normally used
- the goods correspond to the quality or design of the agreed sample or model, if quality or design was determined according to the agreed sample or model
- the goods are in the appropriate quantity, measure or weight
- the goods comply with legal requirements
- The provisions in the previous point do not apply to goods sold at a lower price for a defect for which the lower price was agreed, to wear caused by normal use, to used goods for a defect corresponding to the degree of use or wear the goods had at the time of receipt, or if it results from the nature of the goods.
IX. Complaint Procedure
- The buyer may file a complaint about defective goods at the seller's premises or by email at info@3dstisk.cz.
- The seller recommends using the complaint form when filing a complaint about defective goods.
- The seller informs the buyer about the receipt of the complaint and provides confirmation of when the complaint was filed, its content, and what method of resolution the buyer requests.
- The seller will resolve the complaint, including defect removal, within 30 days of filing, unless a longer period is agreed upon with the buyer.
X. Out-of-court Consumer Dispute Resolution
The Czech Trade Inspection Authority, with its registered office at Štěpánská 567/15, 120 00 Prague 2, ID: 000 20 869, website: http://www.coi.cz, is competent for out-of-court resolution of consumer disputes arising from purchase agreements.
XI. Final Provisions
- The buyer may save and archive these terms and conditions using the print function of their internet browser.
- The seller reserves the right to amend these terms and conditions. The new version takes effect upon publication in the web interface.
